WASHINGTON (AP) The Pentagon says it is investigating Democratic Sen. Mark Kelly of Arizona for possible breaches of military law after Kelly joined a handful of other lawmakers in a video that called for U.S. troops to refuse unlawful orders.
The Pentagons statement, which was posted on social media on Monday, cited a federal law that allows retired service members to be recalled to active duty on orders of the defense secretary for possible court-martial or other measures. Kelly served in the U.S. Navy as a fighter pilot before going on to become an astronaut. He retired at the rank of captain.
It is extraordinary for the Pentagon, which until the second Trump term has usually gone out of its way to act and appear apolitical, to directly threaten a sitting member of Congress with investigation.
In its statement, the Pentagon suggested that Kellys statements in the video interfered with the loyalty, morale, or good order and discipline of the armed forces by citing the federal law that prohibits such actions.

I suspect that Kegsbreath is jealous of Sen. Kelly because he can't even come close to what the Sen. has accomplished in his life, Military and Civilian.

I think they are going to make the argument that, based on the SCOTUS ruling that the president can't do anything illegal in the performance of his core duties that any order he gives as commander in chief is therefore always legal
I'm not a lawyer so take that with a grain of salt.

(5,293 posts)An illegal order would be one that violates existing law or the Constitution. Right? So how would issuance of such a law be within core duties?
There are plenty of things not legislated or in the C, on these the President can and should issue orders if he or she feels its necessary to secure our liberty or freedom. But there is plenty where conduct is defined and issuing orders against these would be illegal. Take it to court if something is unclear. Hell, hes got a rubber stamp of a SCOTUS. Nothing to fear there DJT.

The purpose of these persecutions (Sen Kelly, James Comey, Ms James, etc) is to make headlines for his MAGA base and cause financial hardship for anyone they go after. Sitting here its easy to say Id tell him to go f
himself but thats really a dumb answer.
When the Department of (In)Justice comes after you you need to lawyer up big time. Trumps legal expenses are covered by us taxpayers. The defendants will be forced to spend tens of thousands of dollars every week to take care of the army of lawyers and staff needed to prepare a defense.
People on the sidelines but, as for now, out of the administrations crosshairs, note that and temper their conduct and statements because they have no desire to take their turn in the barrel.

(76,429 posts)Even MAGAts who are veterans know that illegal orders are subject to be disobeyed. The only justification that Dear Leaders offers them honestly is that Dear Leader openly says he wants retribution/vengeance on anybody who put him through charges, never mind that those charges were legitimate. They're fine with that, even if they admit there's no legitimacy to the current things.

(13,600 posts)Morale is at such a low even among civilians that my grandson, who'd been planning to enlist after his HS graduation for the education and spousal benefits, has delayed both enlistment and marriage (thank goodness on the second, from grandma's POV, although I like his GF very much) until AFTER this administration is gone and is working for a building contractor.
