Trump Orders Hegseth and Bondi to 'Determine How Military' Can Be Used in Domestic Law Enforcement

President Donald Trump directed Secretary of Defense Pete Hegseth and U.S. Attorney General Pam Bondi to determine how the U.S. military could be used for domestic law enforcement on Monday.
In an executive order titled, Strengthening and Unleashing Americas Law Enforcement to Pursue Criminals and Protect Innocent Civilians, Trump issued several directives, including the establishment of a legal defense mechanism for law enforcement officers and a crackdown on state and local officials who willfully and unlawfully direct the obstruction of criminal law, including by directly and unlawfully prohibiting law enforcement officers from carrying out duties.
The president also ordered Hegseth and Bondi to determine how military and national security assets and personnel can most effectively be utilized to prevent crime:
Sec. 4. Using National Security Assets for Law and Order. (a) Within 90 days of the date of this order, the Attorney General and the Secretary of Defense, in consultation with the Secretary of Homeland Security and the heads of agencies as appropriate, shall increase the provision of excess military and national security assets in local jurisdictions to assist State and local law enforcement.
(b) Within 90 days of the date of this order, the Secretary of Defense, in coordination with the Attorney General, shall determine how military and national security assets, training, non-lethal capabilities, and personnel can most effectively be utilized to prevent crime.

Summary
The Posse Comitatus Act states that "Whoever, except in cases and under circumstances expressly authorized by the Constitution or Act of Congress, willfully uses any part of the Army or the Air Force as a posse comitatus or otherwise to execute the laws shall be fined under this title or imprisoned not more than two years, or both." 18 U.S.C. § 1385. It reflects an American tradition that bridles at military involvement in civilian affairs. Congress, however, has approved a number of instances where extraordinary circumstances warrant a departure from the general rule, particularly in cases where the armed forces provide civilian assistance without becoming directly involved in civilian law enforcement. However, a number of statutes, including the Insurrection Act, permit the military directly to execute federal law or provide assistance to states in the throes of insurrection where state officials are unable to execute the law.
Three tests have developed to determine when the Posse Comitatus Act is violated. Courts examine whether: (1) civilian law enforcement officials made a direct active use of military investigators to execute the law; (2) the use of the military pervaded the activities of the civilian officials; or (3) the military was used so as to subject citizens to the exercise of military power which was regulatory, prescriptive, or compulsory in nature. The Act has apparently been used for only a couple of prosecutions, and it is more frequently invoked collaterally as a usually unsuccessful means to avoid jurisdiction or exclude evidence acquired with the assistance of the military. Less frequently, plaintiffs have sought relief in the form of civil damages for an alleged violation.
The Posse Comitatus Act does not apply where the Constitution expressly authorizes the use of the armed forces to execute the laws in such a role. Although the Constitution does not seem to provide such an express exception, military doctrine permits military commanders to exercise emergency authority and to take action to protect federal property.
Although the Posse Comitatus Act applies on its terms only to the Army and Air Force, Department of Defense regulations governing military assistance to civil authorities limit the roles of all of the armed services, including civilian personnel, to prevent their direct involvement in law enforcement activities. The National Guard is covered by the act only when acting in federal service.
The most significant impact of the Posse Comitatus Act is attributable to compliance by the armed forces. As administrative adoption of the act for the Navy and Marines demonstrates, the military has a long-standing practice of avoiding involvement in civilian affairs which it believes are contrary to the Act.

(2,637 posts)1) Blue governors might not be able to mobilize the National Guard units in their state. If someone in the Trump administration knows their history (stop laughing), they could pull a Johnson (the former President, not Speaker) and nationalize the troops in their state. This puts the units under Federal control, not state.
2) There is no such thing as a blue or red National Guard unit. Just like the states, everything is a mixture. No one is going to be enthusiastic about shooting anyone, I think.
I have no idea how things are in the Guard these days. My only experience is from my father being in it full time in the 70s. I recall things being a bit more
lets call it laid back. I dont think any of the people in my fathers unit would be eager to start shooting at American citizens, let alone fellow Guard members. I could very well be wrong on this. Maybe the NG has tightened up a bit. After all, its been 50 years (that long?!) and a few conflicts since then.

(37,242 posts)Each state has its own Guard units, and they don't have federal commanders. I don't know how Chump or the US military could "command" them.
Also I find it hard to believe that ANY Governor - R or D - would use their National Guard against another state. That would truly be the end of everything. But it couldn't happen unless some Governor goes rogue for Chump.

(920 posts)Legally, a President can federalize, or take control over State National Guard units. States can also have something called a State Defense Force, which is under the sole command of the State Governor, and can not be federalized like the State National Guard. The State Defense Forces are essentially State Militia. For example, the State Defense Force in New York is called the New York Guard. Unfortunately, their numbers are very small and negligible compared to the U.S. Military and the National Guard. My thought is that perhaps Blue State Governors could expand their respective State Defense Forces but I am not sure how realistic that is and how quickly it could be done.

Expect protests to be met with assault rifles and armored personnel carriers. Army helicopters in the air and orders to shoot those who fail to comply with orders to disperse.
The big question is who will carry it out. Sure, Hegseth is all over such action, but those from Pentagon officers down to field soldiers may not want to take action against friends, family, and neighbors.

You could argue Trump was too - all those bankruptcies, but gullible voters saw him as a "successful businessman" - twice. But I suppose they'd seen him play one on TV, and that was good enough for them - I'm not sure if Peter took into account play-acting at being competent.

(12,358 posts)However, the immunity SCOTUS created (from whole cloth) would shield Trump from prosecution. The SCOTUS created immunity does not protect people beneath the President and certainly not members of the military, at least the Title X, i.e. federal, forces. National Guard personnel are not subject to the Posse Comitatus Act unless they are federalized.
If I was still a serving Army Judge Advocate, I would advise any commander given an order to violate the Posse Comitatus Act that they must disobey the order or risk prosecution.

(12,584 posts)That's exactly why I said what I said, that based on current Supreme Court rulings, the president seems to now be excluded from the "whoever" in the Posse Comitatus Act, in that he cannot be prosecuted, cannot be "fined...or imprisoned not more than two years, or both". Under current SC interpretation, the act effectively does not apply to Trump.
re: "The SCOTUS created immunity does not protect people beneath the President and certainly not members of the military" -- True, but for federal crimes, he has the ability to pardon anyone he wants to, which in this case could include anyone who follows his orders.

(12,358 posts)A violation of the Posse Comitatus Act would certainly be a "high crime or misdemeanor" subjecting Trump from impeachment. All we need is a majority in the House and a super majority in the Senate.
A violation of the Posse Comitatus Act just might be the type of criminal activity that would garner a few GOP votes to convict, especially if the public reacts as a badly as it should to turning federal troops on the public.
I also hold out some hope that SCOTUS might reconsider its creation of presidential immunity. The decision is so obviously wrong, invites so many evils, and so upends the nature of the constitutional balance, that SCOTUS really ought to recant.

I also am worried, because it has was demonstrated during the J6th Treasonous event, that there were many Capitol Police, D.C. Police, D.C. National Guard that actually assisted the insurrectionists. I have to wonder how deeply the Trumphumpers have covertly infiltrated the U.S. Military, Secret Service, FBI, State and Local LEO's, etc etc etc....

To be taken to a prison or a camp. Of course, we who resist this tyranny are the real Americans, and Trump and his gang of MAGA criminals are the real traitors-- Traitors to America and the Constitution.
