'The opposite of diversity is segregation': Judge castigates Trump over anti-DEI policies, but says he cannot intervene

A federal judge in Maryland on Thursday expressed severe misgivings about the Trump administrations efforts to root out diversity, equity, and inclusion (DEI) initiatives, but insisted he had little power to change the current state of play in an ongoing legal battle. In the underlying litigation, the National Association of Diversity Officers in Higher Education, a membership organization, won a late February injunction barring the new policies.
This initial victory came when U.S. District Judge Adam B. Abelson, a Joe Biden appointee, found that the directives were both unconstitutionally vague and violative of the First Amendments free speech protections. But the victory was short-lived. On March 14, Chief Judge Albert Diaz of the 4th U.S. Circuit Court of Appeals, along with Circuit Judges Pamela Harris and Allison Rushing, granted the governments request for a stay pending appeal. The plaintiffs, undeterred, then asked Abelson to vacate his original injunction, citing what the court termed new factual developments. This effort was in service of a bid for a new preliminary injunction.
[T]hey believe that evidence related to agencies interpretation and implementation of the Executive Orders would further support the likelihood of success on the merits of their already-asserted claims, and further that they could amend their complaint to add new facial claims challenging the executive order provisions at issue, the court explains. The new facial claims Plaintiffs state they may add in an amended complaint would be claims under the Administrative Procedures Act.
Such an injunction would more or less reset the case and force the Trump administration to spend several weeks requesting and litigating another stay. And, the plaintiffs argued, even the appellate panel that paused the first injunction would be amenable here.

(45,174 posts)It was stayed pending appeal by a three judge panel of the fourth circuit -- two Obama judges and one Trump judge. The district court judge was asked to vacate its original ruling and allow the plaintiffs a do-over so they could get a new preliminary injunction. Such a request is rarely granted and wouldn't change things in the long run -- there would be no preliminary injunction in place while the new request was litigated and as soon as the new injunction was granted -- which I'm certain the district judge you are castigating would grant -- it would be stayed again by the court of appeals. In short, the result would be a delay in getting a decision with the EO still in effect.
I'm curious what you think the district court judge in this case should have done differently.

Some of the damage will never be repaired.
And instead of everyone wringing their hands and lecturing us endlessly about how powerless the judges
are, maybe they can get off their lazy asses and face the challenges head on.
The judges are mandated by the US constitution and their oaths to be a GD CHECK AND BALANCE
on POTUS.
I am asking them to do their damn jobs and start fulfilling their duties and stop acting helpless.
They are weak inert fools. They have allowed a vicious psychopath to come to power.
Many of us in our lives have faced severe challenges and we didn't sit around pretending to be
helpless and stupid like US judges are doing right now.
How anyone can defend the judiciary right now is beyond my understanding.
Allowing evil to flourish is complicity. The judges are complicit in the US descent into darkness.

them how to do their jobs, they need to find another line of work.
Maybe they could handle the job of Walmart greeter.
They are mandated by law to be a check and balance.
They went to law school.
So they need to figure out how to do their jobs.
They work for the American people.
So get off their asses and do their jobs and check the psychopath in office.
Reaming me out is ridiculous. The ones you should be attacking are
the lazy ass worthless people in black robes, cashing in with cushy jobs
and benefits who are inert fools.

All the BS American judges keep doing.
US troops showed great courage, risked their lives, developed plans out in the field, planned, strategized,
and defeated evil.
US judges are cowards.
