Uber and DoorDash Lose Bid to Quash NYC Tipping Law

Source: PYMNTS

Delivery companies have reportedly lost their bid to halt New York City’s new tipping law.

Uber and DoorDash had asked a judge for an injunction to block the new law, which requires food delivery apps to offer customers the option to tip delivery workers, Reuters reported Friday (Jan. 23).

According to the report, U.S. District Judge George Daniels in Manhattan said the companies did not demonstrate a clear likelihood of succeeding on their claims that the laws, including a requirement that they recommend a minimum tip of 10%, violated their First Amendment rights to free speech.

DoorDash and Uber sued to block the law last month. It requires platforms such as theirs to ask customers to tip during checkout rather than delivery and to display suggested tip amounts.

2. Since the whole point of Door Dash is the delivery, why would you tip at checkout?

Now the driver already has the tip in hand before you even know how the delivery is going to go.

6. Then you don't have to

You can opt to not tip at check out and tip when they arrive
Considering there are orders that want the driver to leave the food at the door and leave, this would give people that option
Some people are not home when the food arrives

8. Because many people forget to tip after they get their food

The app doesn't remind you after the order is complete. You would have to go into the app again, click your last order, and then it will give tip options.

With the new law, it's just like it was before last year. It gives the option to tip (and how much to tip) right before you place your order. You can still decline.

9. Perhaps sit down restaurants should solicit tips before they even bring you your food, so you don't forget later

IMO, tips should be based on the level of service you get.

I wouldn't be very happy to tip a door dash driver a generous amount, just to find out that they got lost on the way and then dropped it in the street before they delivered it.

Since I would never pay someone to deliver my food vs just picking it up myself maybe I just don't get it. My 20 year old heathy able bodied niece used to have door dash deliver some ice cream from Dairy Queen. I guess I'm too thrifty to spend $10 for a $4 ice cream.

10. Apples and oranges

I've served at restaurants in the past, and 99% tip at the end. I do DoorDash now occasionally when I'm bored or broke, and with their new policy, I'd say only 1 out of 10 tip now. It is over a 60% drop. Last week I did it in the snow. Three deliveries, no tip.

Perhaps you'd support a compromise. After the order arrives, maybe have the app pop up with "Was everything alright with the food/service? Would you like to add a tip?"

4. Why does NY still have sub minimum for servers?

CA has regular minimum.

That said, a lot of people up here in Canada have stopped tipping. When they bring you the machine here, the tip options start at 20%. The FOH is sometimes making more than BOH.

Same with delivery. They give you the machine and the options start at 20%. Really insane.
