Attorney General Tim Griffin says Arkansas Board of Corrections can't choose its own attorney

June 17, 2025

The Arkansas Board of Corrections needs an attorney for a civil suit with the state Attorney General and wants the guy they've been working with.

The Attorney General's office says the board doesn't get to make that choice.

Zach A. Mayo, the general counsel to Attorney General Tim Griffin, said in a letter sent Tuesday to the Corrections Board's attorney that board members cannot select outside counsel for litigation. That right, Mayo said, lies with Gov. Sarah Huckabee Sanders' office.

The letter comes one day after the Board of Corrections voted to certify the need for an outside attorney in a lawsuit against Griffin's office and offered to discuss settling the lawsuit.
