AI companies' theft of the world's intellectual property was both illegal and unethical. Even if they succeed in getting laws changed, the theft will still be unethical.
People who are aware of that IP theft and don't think it matters have taken a stand on that legal and ethical issue, and it's the wrong stand. For liberals, anyway. For people who favor human rights over corporate exploitation. The AI companies were quite aware it was theft.
And since generative AI is flawed - genAI models aren't intelligent, are little more than fancy autocomplete, and will always hallucinate no matter how good the data set of stolen IP - it's less like a regular fork than like a badly produced fork that might break in any way at any time. AI companies tell users that their flawed tech makes mistakes, so they should always check its results. You don't see companies selling flatware having to warn people that they should check the fork's tines after every bite - and before swallowing - in case part of the fork broke off.
