(48,276 posts)48. As far as I can tell, this would not qualify as a statutory rape in West Virginia,
because of their age difference. He is listed at 36 and she is listed at 33, so he is 3 years older than she is. So even being under 16, because he is only 3 years older, would not qualify as a statutory rape.
Obviously, whatever West Virginia thinks of it, it's still a really bad situation for a 15 year old to be in. And never mind the two of them kept producing a kid after kid, and apparently barely took care of all those children.
