Interesting for the passenger though. It's a second degree misdemeanor if you refuse. And, of course, becomes part of your permanent record--which means it will show up on a background check.

For the passenger, unless they are being accused of something related to the moving violation, like not wearing a seat belt, it seems to be a due process violation. Although I'm sure Alito and Thomas will be all for it.
